Power of Attorney - Through a power of attorney, you can give someone else (your agent) the power to act on your behalf. Most people create this document in the event they become incapacitated. Probate - Probate is the actual process that transfers legal title of property from the estate of the person who has died (the "decedent") to his or her proper beneficiaries. The term "probate" also refers to proving of the existence of a valid will or determining and (proving) who one's legal heirs are if there is no will. Decedents can't take it with them (or inform you from the other side of their wishes). Probate is the process used to determine who gets the decedent's property.
